What South African law requires

Inquests Act 58 of 1959: Sudden, violent, or unexplained deaths must be reported to the South African Police Service (SAPS) and referred to a magistrate for an inquest. For Hermanus, the relevant Magistrates Court is the Hermanus Magistrate’s Court (Lord Roberts Drive). The investigating officer is drawn from SAPS Hermanus station.

Death certificate: Issued by the Department of Home Affairs under the Births and Deaths Registration Act 51 of 1992. The DHA Hermanus office handles local registrations. A death cannot be registered until a Notice of Death (BI-1663 form) is completed by a doctor and submitted.

Health certificate for export: Issued by the Western Cape Department of Health under the National Health Act 61 of 2003 regulations for international transport of human remains.

Hospital coverage

Hermanus Hospital (Hospital Street, Hermanus) is a public hospital operated by the Western Cape Department of Health. It provides basic acute and emergency care but does not have a full intensive care unit or specialist surgical capability. Serious cases are transferred to Tygerberg Hospital (Parow, Cape Town) or Groote Schuur Hospital (Observatory, Cape Town). Private hospital cover in Hermanus is limited; some residents hold medical aid (South African private health insurance) with Mediclinic or Netcare. Deaths in Cape Town hospitals following transfer from Hermanus are registered in Cape Town, not Hermanus.

Cape Town International Airport (CPT, 120km west of Hermanus via the N2) is the departure airport. British Airways operates CPT-LHR direct (approximately 11.5 hours). The road transfer from Hermanus to CPT takes approximately 1.5 hours under normal conditions via the N2. Funeral directors in Hermanus or Stellenbosch with repatriation experience handle the CPT cargo process. Hermanus itself does not have an airport.

Long-stay resident and retirement considerations

British nationals resident in Hermanus may hold a South African permanent residence permit or retirement visa. South African succession follows the Administration of Estates Act 66 of 1965; the Master of the High Court administers deceased estates and a Letters of Executorship is required before South African assets can be transferred. Where the deceased held both South African and UK assets, the estate runs as a parallel process in both countries. This should not delay repatriation, but families who appoint a South African attorney early avoid months of delay in the estate later.
